BAB VII
PEMBEKUAN DAN PEMBUBARAN
Pasal 13
Pemerintah dapat membekukan Pengurus atau Pengurus Pusat Organisasi Kemasyarakatan apabila Organisasi Kemasyarakatan :
a. melakukan kegiatan yang mengganggu keamanan dan ketertiban umum;
b. menerima bantuan dari pihak asing tanpa persetujuan Pemerintah;
c. memberi bantuan kepada pihak asing yang merugikan kepentingan Bangsa dan Negara.
Pasal 14
Apabila Organisasi Kemasyarakatan yang Pengurusnya dibekukan masih tetap melakukan kegiatan sebagaimana dimaksud dalam Pasal 13, maka Pemerintah dapat membubarkan organisasi yang bersangkutan.
Pasal 15
Pemerintah dapat membubarkan Organisasi Kemasyarakatan yang tidak memenuhi ketentuan-ketentuan Pasal 2, Pasal 3, Pasal 4, Pasal 7, dan/atau Pasal 18.
Pasal 16
Pemerintah membubarkan Organisasi Kemasyarakatan yang menganut, mengembangkan, dan menyebarkan paham atau ajaran
Komunisme/Marxisme-Leninisme serta ideologi, paham, atau ajaran lain yang bertentangan dengan Pancasila dan Undang-Undang Dasar 1945 dalam segala bentuk dan perwujudannya.
Pasal 17
Tata cara pembekuan dan pembubaran Organisasi Kemasyarakatan sebagaimana dimaksud dalam Pasal 13, Pasal 14, Pasal 15, dan Pasal 16 diatur dengan Peraturan Pemerintah.
BAB VIII
KETENTUAN PERALIHAN
Pasal 18
Dengan berlakunya Undang-undang ini Organisasi Kemasyarakatan yang sudah ada diberi kesempatan untuk menyesuaikan diri dengan ketentuan Undang-undang ini, yang harus sudah diselesaikan selambat-lambatnya 2 (dua) tahun setelah tanggal mulai berlakunya Undang-undang ini.

The government is considering suspending the Islam Defenders Front (FPI) for its attack on activists Sunday at the National Monument (Monas).
Coordinating Minister for Politics, Law and Security Widodo Adi Sucipto said Monday the government was looking at a 1985 law that allows for the suspension of a mass organization.
The decision was made in a meeting led by President Susilo Bambang Yudhoyono on Monday evening to discuss proper measures against the hard-liners following the attack.
“We should not only see this problem as a violent action, but as something that may tarnish our country’s civilization,” Widodo told a news conference after the meeting at his office in Central Jakarta.
“We are now conducting strict legal processes in this case,” he added.
Widodo said the President had ordered an investigation of the organization that ambushed activists from the National Alliance for the Freedom of Faith and Religion (AKKBB) at Monas, who were rallying to commemorate the 63rd year of Pancasila state ideology and also to support members of the Jamaah Ahmadiyah Islamic sect.
“I think the Home Ministry will study it further,” he said when asked about the possibility of the government disbanding the FPI.
“We should put this problem within the context that every mass organization must be in line with the 1985 law.”
Under the 1985 law, the government can freeze the central board of a mass organization if it commits an act harmful to order and security, receives foreign assistance without government consent or support foreign parties that could act counter to national interests.
Should an organization continue conducting unlawful activities, the law further gives the government power to disband it.
However, Attorney General Hendarman Supandji said there should be several steps taken by the government before suspending an organization.
“First, we issue them reprimands, then we go to the Supreme Court,” he said.
Earlier Monday at the presidential office, Yudhoyono condemned the attack and ordered actions to be taken against the perpetrators.
“I am deeply concerned with what happened yesterday afternoon. I strongly condemn the attackers that caused injuries to our people,” he said.
“Our nation is bound by the law and Constitution and is not a country that supports violent acts. In regard to this incident, the law must be upheld.
“Indonesia is a lawful state, not an anarchic state. We should not be defeated by violent actions.”
The President also called on people to maintain order when staging demonstrations and ordered the police to be tough in the face of violence.
“The police should continue implementing preventive measures to avoid similar incidents. Be strict, but do not carry out excessive actions that may instigate new problems,” he said.
Vice President Jusuf Kalla and House of Representatives Speaker Agung Laksono also denounced the attack and asked the authorities to arrest all those behind it.
“The incident has led our nation to sink deeper amid many economic problems including the fuel prices increases,” Agung said.
At a press conference Monday, FPI leader Habib Rizieq Shihab declared war on members and supporters of Ahmadiyah.
“We will never allow for the arrest of a single member of our force before the government dissolves Ahmadiyah. We will fight to our last drop of blood,” he said.
The government remained undecided on when it would issue a decree on Ahmadiyah.
“The joint ministerial decree is still being processed by the Religious Affairs Ministry, the Attorney General’s Office and the Home Ministry, and we will announce it later,” Widodo said. “In time, the government will issue its decision on this matter.”

Lembaga Ketahanan Nasional (Lemhanas) menilai, pemerintah tidak bisa menjadikan UU No 8/1985 tentang Organisasi Kemasyarakatan sebagai acuan untuk membubarkan Front Pembela Islam (FPI), mengingat undang-undang itu tidak lagi, sejalan dengan semangat reformasi dan perwujudan masyarakat madani.
“UU No 8/1985 lebih kental nuansa Orde Barunya dan cenderung represif. Sedangkan dalam semangat reformasi dan demokratisasi UU itu tidak sejalan lagi terutama dalam hal mendukung kebebasan berorganisasi, dan mengeluarkan pendapat,” ujar Gubernur Lemhanas Muladi di Jakarta, Kamis (5/6).
Pada era Orde Baru, UU No 8/1985 bisa dipakai untuk membubarkan sebuah ormas yang dianggap melenceng dari visi misinya dan mengganggu stabilitas keamanan.
“Namun pada era sekarang, kebebasan organisasi dan mengeluarkan pendapat sangat di junjung tinggi karena berorganisasi dan mengeluarkan pendapat merupakan elemen demokrasi dalam rangka mewujudkan `civil society` (masyarakat madani),” tutur Muladi.
Jika pemerintah ingin membubarkan sebuah ormas termasuk FPI maka harus ada acuan baru yakni dengan melakukan perubahan terhadap UU Tentang Ormas yang lebih demokratis dan mendukung perwujudan masyarakat madani.
Pemerintah akan mengkaji pembekuan organisasi Front Pembela Islam (FPI) pasca insiden Monas, Minggu (1/6), berdasar UU No.8 tahun 1985 tentang Organisasi Kemasyarakatan.
“Mengenai (pembubaran) organisasi, kami akan melakukan sesuai UU No.8 tahun 1985,” kata Menteri Koordinator bidang Politik, Hukum, dan Keamanan (Menko Polhukam) Widodo AS, usai rapat kabinet terbatas bidang Polhukam yang dipimpin Presiden Susilo Bambang Yudhoyono di Jakarta pada Senin malam.
Ia menyatakan Presiden telah menyerahkan sepenuhnya penyelesaian insiden ini pada Menkopolhukam dan menteri di bawahnya.
“Nanti Departemen Dalam Negeri yang akan mendalami,” kata Widodo.
Sementara itu, Jaksa Agung Hendarman Supandji menegaskan UU tentang organisasi kemasyarakatan itu dijabarkan dalam Peraturan Pemerintah (PP) No.18 tahun 1986.
“Istilahnya bukan dibubarkan tapi dibekukan,” ujar Hendarman.
Ia mengatakan, berdasarkan UU pihak yang berwenang menangani pembekuan ormas ialah Menteri Dalam Negeri dan institusi lain yang membidangi soal itu.
Tentang waktu pembubaran terhadap FPI, Hendarman menyatakan belum tahu.
Yang jelas, tambah dia, sebelum membekukan FPI, pemerintah akan memberi dua kali peringatan.
“Peringatan dua kali, baru minta fatwa ke Mahkamah Agung,” katanya. [TMA, Ant]
Yang penting perlu dicermati bahwa kelakuan kekerasan adalah dilaukan oleh individu atau oknum. Merekalah yg harus dituntut dan diadili. Perlu juga ditelaah apakah tindakan kekerasan itu adalah kebijakan resmi pengurus ormas tsb atau bukan. Kalau memang ormas tsb jelas2 tidak berkebijakan kekerasan maka hanya anggotanya yg patut terkena tidakan hukum baik sanksi organisasi maupun sanksi hukum.
Tapi kalau memang organisasinya yg berkebijakan kekerasan maka patut dibubarkan.
